Provisions on handling violations of discipline and discipline in public recruitment of public institutions

Chapter I General Principles

Article 1 In order to strengthen the management of open recruitment in public institutions, standardize the identification and handling of violations of discipline and discipline in open recruitment, and ensure the openness, fairness and impartiality of recruitment, these Provisions are formulated in accordance with the Regulations on Personnel Management in Public Institutions and other relevant provisions.

Article 2 These Provisions shall apply to the determination and handling of violations of discipline and discipline in public recruitment of public institutions. ?

Article 3 The identification and handling of open recruitment violations shall be based on clear facts, conclusive evidence, standardized procedures and accurate applicable provisions.

Article 4 The comprehensive personnel management department of central institutions shall be responsible for the comprehensive management and supervision of the open recruitment of public institutions throughout the country.

The comprehensive personnel management departments of public institutions at all levels, the competent departments of public institutions and the recruiting units shall, in accordance with the management authority of public institutions, identify and deal with violations of discipline and discipline in public recruitment in accordance with these Provisions.

Chapter II Handling of Disciplinary Actions of Candidates

Article 5 If an applicant commits any of the following violations of discipline and discipline during the registration process, his qualification for this application shall be cancelled:

(a) forged or altered documents, certificates and other registration materials, or obtained the qualification by other improper means;

(2) The application materials or information provided concerning the qualification for registration are false, which affects the results of registration examination;

(three) other violations of discipline and discipline that should cancel the qualification for this application.

Article 6 If a candidate commits any of the following violations of discipline and discipline during the examination, he/she shall be given the treatment that his/her examination results in this subject are invalid:

(a) to bring articles outside the provisions into the examination room and not put them in the designated position as required, and still not correct them after being reminded;

(2) Failing to take the examination at the prescribed seat, or leaving the seat or examination room without the permission of the examination staff, and still failing to make corrections after being reminded;

(three) after being reminded, I still don’t fill in and fill in my information according to the regulations;

(four) in the test paper, answer sheet, answer sheet outside the provisions of the position marked with my information or other special marks;

(5) Answering questions before the start signal of the exam is issued, or continuing to answer questions after the end signal of the exam is issued, and still does not stop after being reminded;

(6) Taking the test paper, answer sheet and answer sheet out of the examination room, or intentionally damaging the test paper, answer sheet and test-related facilities and equipment;

(seven) other violations of discipline and discipline that should be given when the examination results of this subject are invalid.

Article 7 If a candidate commits any of the following serious violations of discipline and discipline during the examination, his/her examination results in all subjects at that time shall be invalid, and his/her violations of discipline and discipline shall be recorded in the integrity archives of open recruitment candidates in public institutions for a period of five years:

(1) Plagiarism or assisting others in plagiarism;

(2) Passing examination papers, answer sheets, answer sheets and draft papers to each other;

(three) to take the exam with forged documents;

(four) the use of communication tools prohibited from being brought into the examination room or electronic products other than those specified;

(five) after I left the examination room, before the end of the examination, I disseminated the examination questions and answers;

(six) other serious violations of discipline and discipline that should be invalid for all subjects in the current examination and recorded in the integrity archives of open recruitment candidates in public institutions.

Article 8 If a candidate commits one of the following particularly serious violations of discipline and discipline, his/her examination results of all subjects in the current session shall be invalid, and his/her violations of discipline and discipline shall be recorded in the integrity archives of candidates openly recruited by public institutions for long-term record:

(1) colluding in cheating or participating in organized cheating;

(two) to take the exam instead of others or let others take the exam instead of themselves;

(three) other particularly serious violations of discipline and discipline that should be invalid for all subjects in the current examination and recorded in the integrity archives of open recruitment candidates in public institutions.

Article 9 Applicants should consciously maintain the recruitment order and obey the staff management. If they commit any of the following acts, they will be terminated from continuing to take the exam and ordered to leave the site. If the circumstances are serious, it shall be handled in accordance with the provisions of Articles 7 and 8 of these Provisions; Violation of the "People’s Republic of China (PRC) Public Security Administration Punishment Law" shall be handled by the public security organs according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Deliberately disturbing the order of test centers, examination rooms and other recruitment workplaces;

(two) refusing or obstructing the staff from performing their management duties;

(3) Threatening, insulting, slandering or framing staff members or other candidates;

(four) other violations of discipline and discipline that disrupt the order of recruitment.

Tenth in the process of marking, it is found that the candidates have the same answers in the same subject, which is confirmed by the marking expert group, and the results of the examination in this subject will be invalid. The specific methods and standards for identifying the same answers shall be determined by the comprehensive personnel management department of the central institutions.

If the answers to the same subject among candidates are similar, and there are other relevant evidences to prove that their violations of discipline and discipline are established, they shall be dealt with in accordance with Articles 7 and 8 of these Provisions as the case may be.

Article 11 Applicants who resort to deceit or conceal diseases and medical histories that affect their employment during the medical examination shall be given the treatment of refusing to be employed. If someone else is invited to take the place of physical examination, exchange or replace laboratory samples and other serious violations of discipline and discipline, they will be dismissed, and their violations of discipline and discipline will be recorded in the integrity archives of open recruitment candidates in public institutions for a period of five years.

Twelfth candidates in the course of inspection to provide false materials, conceal the truth or other acts that hinder the inspection work, interfere with and influence the inspection unit to make an objective and fair conclusion, and give them a refusal to hire; If the circumstances are serious and the influence is bad, the violation of discipline and discipline shall be recorded in the integrity archives of open recruitment candidates of public institutions for a period of five years.

Article 13 If a candidate is found to have any violation of discipline and discipline listed in these Provisions after being employed, the employing unit shall terminate the employment contract with him and dismiss him. Those who meet the violation of discipline and discipline in Article 7, Article 8, Article 11 and Article 12 shall be recorded in the integrity archives of the candidates openly recruited by public institutions.

Article 14 The integrity archives of public recruitment candidates in public institutions shall be established by the comprehensive personnel management department of central institutions, and incorporated into the national credit information sharing platform to provide inquiries to the recruiting units and the society. Relevant records shall serve as an important reference for the employees employed by public institutions, and the management measures shall be formulated separately.

Chapter III Handling of Violations by Recruiting Units and Recruiting Staff

Fifteenth recruitment units in the open recruitment of one of the following acts, the competent department of public institutions or institutions comprehensive personnel management department shall be ordered to make corrections within a time limit; If no correction is made within the time limit, the directly responsible person in charge and other directly responsible personnel shall be punished according to law:

(1) Organizing open recruitment without approving (filing) the recruitment plan according to the prescribed authority and procedures;

(2) Setting directional or restrictive conditions unrelated to the post;

(3) Failing to issue a recruitment announcement as required;

(four) after the release of the recruitment announcement, the recruitment procedures, job conditions, the number of recruits, examination and inspection methods, etc. are changed without authorization;

(5) Failing to conduct qualification examination according to the recruitment conditions;

(6) failing to organize a medical examination as required;

(seven) failing to publicize the list of persons to be employed in accordance with the provisions;

(eight) other violations of discipline and discipline that should be ordered to correct.

Sixteenth recruitment staff has one of the following acts, the relevant departments shall give punishment, and stop them from continuing to participate in the recruitment work of the current year and the next year:

(a) to advance the start time of the examination, postpone the end time of the examination and shorten the examination time without authorization;

(2) changing examination rooms or seats for candidates without authorization;

(three) did not accurately record the examination room and violations of discipline, and caused a certain impact;

(4) Failing to implement the challenge system;

(five) other general violations of discipline.

Seventeenth recruitment staff has one of the following acts, by the relevant departments to be punished, and transferred from the recruitment work, not to engage in recruitment work; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) instigating or conniving others to cheat, or participating in cheating in the process of examination, inspection and physical examination;

(2) disclosing information that should be kept confidential, such as examination questions and interview scoring elements, within the confidentiality period;

(three) to change the examination scoring standards without authorization or not to mark papers according to the scoring standards;

(four) lax supervision, resulting in a large area of cheating in the examination room;

(five) dereliction of duty, resulting in adverse effects;

(six) other serious violations of discipline.

Chapter IV Handling Procedures

Article 18 If a candidate’s violation of discipline and discipline is found on the spot, the recruiting staff shall stop it. For those who are found to be in violation of discipline and discipline, it is necessary to collect and save the corresponding evidence materials, truthfully record the facts of violation of discipline and discipline and the on-site handling situation, inform the candidates of the recorded contents on the spot, and ask them to sign; For those who refuse to sign or maliciously damage the evidence materials, two recruitment staff will truthfully record their refusal to sign or maliciously damage the evidence materials. After the record of violation of discipline and discipline is signed by the person in charge of the test center, it shall be submitted to the department that organizes and implements open recruitment. ?

Article 19 Before a decision is made to deal with a candidate’s violation of discipline and discipline, the candidate shall be informed of the decision to be made and the relevant facts, reasons and basis, and shall be informed that the candidate has the right to state and defend himself according to law. The department that made the decision shall review the facts, reasons and evidence put forward by the candidates.

If a decision is made to deal with the violation of discipline and discipline of the candidates, a decision on the handling of the violation of discipline and discipline in open recruitment shall be made and delivered to the candidates who have been dealt with according to law.

Twentieth candidates who are dissatisfied with the decision may apply for administrative reconsideration or bring an administrative lawsuit according to law.

Twenty-first staff members who participate in open recruitment may apply for review or lodge a complaint according to law if they are dissatisfied with the punishment for violations of discipline and discipline.

Chapter V Supplementary Provisions

Article 22 These Provisions shall come into force as of January 1, 2018.
